A 64-year-old man — who suffered severe brain damage after a ladder he was using collapsed — won an $11 million federal verdict during a retrial against the manufacturer. While on the ladder, the right-side rail collapsed, spilling him onto a cement driveway and causing permanent, severe brain damage. Although the manufacturer was found not liable in the first trial, the original trial counsel objected when the court allowed jurors during their deliberations to inspect a model of the ladder that had not been admitted into evidence. WL handled the appeal and secured the $11 million verdict in the successful retrial ordered by the Seventh Circuit. The injured man remains incapacitated and institutionalized in a skilled nursing care facility where his wife supervises his treatment.
