What is Medical Malpractice?

Medical malpractice occurs when a healthcare provider fails to meet the accepted standard of care, resulting in harm to a patient. These errors can happen in hospitals, clinics, nursing homes, and private practices — and they are often preventable. Victims of medical malpractice may face prolonged illness, unnecessary surgery, permanent disability, or even loss of life. At Wise Law, we help patients and their families navigate these complex claims and pursue justice for the physical, emotional, and financial toll caused by negligent care.

Common Causes of Medical Malpractice

  • Misdiagnosis or Delayed Diagnosis – Failure to identify or properly treat a medical condition
  • Medication Errors – Wrong drug, incorrect dosage, or failure to review patient history
  • Surgical Errors – Operating on the wrong body part, leaving instruments behind, or negligent technique
  • Birth Injuries – Harm to a baby or mother due to improper delivery methods or failure to monitor
  • Anesthesia Mistakes – Incorrect dosage or failure to recognize allergic reactions
  • Failure to Obtain Informed Consent – Performing procedures without properly informing the patient
  • Negligent Post-Operative Care – Infections, complications, or poor follow-up

Common Injuries in Medical Malpractice

Medical malpractice can cause a wide range of serious, sometimes irreversible injuries. Patients may suffer organ damage, infections, internal bleeding, infertility, brain damage, amputations, paralysis, severe complications from botched surgeries, and death. A delayed or incorrect diagnosis can allow conditions like cancer or heart disease to progress unchecked. In birth injury cases, both infants and mothers may experience lifelong complications such as cerebral palsy, nerve damage, or trauma from improper delivery methods. Emotional distress is also common, especially when trust in a healthcare provider is shattered. Our dedicated team of nurses collect medical records and provide recommendations on damages, liability, and responsible parties. Wise Law is committed to holding negligent medical professionals accountable and helping you secure the resources needed for long-term recovery. $35 Million Settlement for….

We represented the mother of a 5-year-old boy who suffered a severe brain injury during birth. The child’s injuries were suffered as doctors performed an emergency cesarean section delivery after the mother had arrived at the hospital that morning experiencing labor pains, but still had not given birth by evening. The attending obstetrician ordered a C-section and paged a senior attending anesthesiologist, who did not arrive until 45 minutes later — due, as we demonstrated in court, to his being in a private room elsewhere in the hospital with an off-duty nurse. The $35 million settlement, according to the Jury Verdict Reporter was, at the time, “substantially higher than any other brain-injury-at-birth case” in Illinois history.
